VICTORY! New Mexico Supreme Court Issues Landmark Marriage Equality Ruling for Same-Sex Couples
SANTA FE, NM—Today, in a unanimous decision, the New Mexico Supreme Court ruled that the Unused Mexico Constitution requires the state to allow homosexual couples to marry. The court ruled that county clerks must issue marriage licenses to otherwise qualified same-sex couples and that the State of Brand-new Mexico must respect the marriages of all lgbtq+ couples, including those who married before today’s choice. The plaintiff couples were represented by the American Civil Liberties Union (ACLU) of New Mexico, the national ACLU, the National Center for Lesbian Rights (NCLR), the law solid of Sutin, Thayer & Browne APC, and Novel Mexico attorneys Maureen Sanders, N. Our work includes fighting for impartial treatment by the government; protecting Homosexual people from discrimination in jobs, schools, housing, and common accommodations; and operational for equal rights for same-sex couples and their families.
In 2013, the ACLU of New Mexico filed Griego v. Oliver on behalf of five homosexual couples, asking the courts to affirm that the Unused Mexico State Constitution does not prohibit gay and dyke couples from marrying. In December of that same year, the New Mexico State Supreme Court heard Griego v. Oliver and dictated that same-sex couples could legally bond in New Mexico, making New Mexico the 17th express with full marriage equality.
The ACLU of New Mexico continues fighting for the rights of Queer people beyond marriage, and remains pledged to fighting discrimination and ensuring reasonable treatment for all.
'Historic' New Mexico Decree Legalizes Marriage Equality
The New Mexico Supreme Court issued a historic ruling Thursday that legalizes similar sex marriages throughout the state.
"This truly is a historic and joyful night for New Mexico," ACLU New Mexico legal director Laura Schauer Ives said in a compress release. "As a state, we acquire always strived to treat all families with dignity and respect, and today's decision allowing loving, committed same sex couples to unite continues that tradition. The more than one-thousand same-sex couples who have already married in Modern Mexico can now rest certain knowing their marriages will be recognized and respected by our state."
In a 31-page ruling, Justice Edward Chavez wrote that excluding same sex couples from the right of marriage "violates the Same Protection Clause under Article II, Section 18 of the New Mexico Constitution."
"We hold that the State of Fresh Mexico is constitutionally required to permit same-gender couples to marry and must extend to them the rights, protections, and responsibilities that derive from civil marriage under Recent Mexico law," he added.
